Using Anime pre-made content commercially

Post by Robo »

Short deadline and looking for a green light...

If I import and use for a commercial project the Anime movies ( Energy Cloud, Energy_Explosion, Explosion), am I breaking the user agreement?
These movies would be used as an element to an animation...e.g., part of
a rocket ship ignition and take off.

I assume I could get similiar if not identical movies if I rendered out the
particle scripts (Energy Cloud, Explosion). Do be free of user agreement
mischief here, do I have to analyze the particle layer settings in the Anime pre-made files, duplicate and use my own vector "art" to get
clearance for rocket take-off?

Any guidance on the restrictions of using Anime pre-made files
as elements to commercial projects would be most welcomed... :?:

The User Agreement is near the beginning of the User Guide. I'm no lawyer, but it does look like you're allowed to use the movies as long as they're rendered into your project:
E. You may copyright and distribute rendered still or animated images derived from the Restricted Content without restriction or royalty to Company provided you do not violate other clauses of this agreement.
The distinction seems to be that you are not distributing the "Restricted Content," you are distributing a rendered product that is DERIVED from the Restricted Content.

I think that as long as nobody can reverse the process and extract the movies from your rendered project, that's okay.

But like I said, I'm no lawyer. And I don't know how this would apply if -- for example -- your customer requires the product sources as well as the rendered file.

Cheers,
Muffy.
