Some people offer download links to get music and movies for free and are not getting any money from them, is this illegal or not?

Sounds illegal to me.
If you can download tracks from a perfectly purchasable CD or movie from a DVD, then yeah it's illegal. Easy way to tell is do a Google on the music, video you are attempting to download to check on it's user rights - there are people who give away their own film and music for free. If you find or are offered downloads for free, with no fees or charges involved, I'd say definitely an illegal download.
